Big victory for 39 women officers of the army in the Supreme Court – will get permanent commission- 39 women officers of the Indian Army have got a big victory in the Supreme Court. The Supreme Court has directed the Central Government to give permanent commission to these women officers and said that orders related to this should be issued soon. Along with this, the Supreme Court has also directed the Central Government to give detailed information about the reasons for not granting permanent commission to 25 other women officers.
Along with this, the court also said that you should give an affidavit in writing on the women officers to whom you have decided not to give permanent commission, whether our decision does not cover permanent commission of all of them.
During the hearing, Additional Solicitor General Sanjay Jain and senior advocate R Balasubramanian, appearing for the Center, told the bench of Justice DY Chandrachud and Justice BV Nagarathna that one of the 72 women officers has applied for release from service. Therefore, the government has reconsidered 71 cases. Of these, 39 have been found eligible for permanent commission.
The central government told the court that 39 out of 71 can be given permanent commission. Along with this, the Center said that out of 71, 7 are medically unfit, while 25 have serious cases of indiscipline and their grading is poor.
On October 8, while hearing the contempt petition filed by the women officers of the army in the Supreme Court, the army was asked to resolve it at its level. The court had said that it should not happen that in this case also we have to give any order again.
If women officers are to be believed, then the Supreme Court had ruled on 25 March 2021 that women officers who have got 60 percent marks in the Special Selection Board and against whom there are no cases of discipline and vigilance, those women officers should be given permanent commission. Despite this, permanent commission has not been given to these women officers yet.
On August 10, these women had sent a legal notice to the Ministry of Defense and the Army, but they also did not get any response, then these women approached the Supreme Court.
